The Australian Government is set to replace the 482 visa with the new Skills in Demand visa by the end of 2024, following the release of the Migration Strategy on 11 December 2023. Although some details are yet to be confirmed, it’s crucial for both sponsors and visa applicants to take action now to avoid being caught unprepared.

Why You Should Submit Your Applications Before November
To minimize the risk of disruption, it’s highly recommended that you submit any nomination and visa applications before late November. Applications lodged before the introduction of the new visa should still be assessed under the current 482 visa criteria.

Key Changes to the Skills in Demand Visa
The new Skills in Demand visa introduces several updates to improve Australia’s skilled worker migration process. Below are the most significant changes you need to know:

New 3-Tier System Based on Occupation and Salary
The new visa will introduce a 3-tier system, with eligibility determined by occupation and salary criteria. This system aims to streamline the process and better meet Australia’s workforce demands. The new visa will offer a 4-year temporary skilled worker pathway.

Reduced Work Experience Requirement
Starting from 23 November 2024, visa applicants will need only 1 year of full-time work experience in their occupation or a related field, a reduction from the current requirement of 2 years.

Casual Employment Now Counts Toward Experience
Applicants will now be able to count casual employment toward the work experience requirement. While full-time work experience is still preferred, this change gives applicants more flexibility in meeting the visa criteria.

No More 5-Year Limit for Work Experience
The requirement for work experience to have been gained within the last 5 years is being removed. This change allows applicants to include more of their career history when applying.

What Sponsors and Applicants Should Do Now

Lodge Applications Before End-November
To avoid complications from the upcoming changes, it’s essential to submit all nomination and visa applications before mid-November 2024. Those submitted before the new visa’s introduction will still be assessed under the existing criteria.

Test the Labour Market
For sponsors intending to hire foreign workers, the window for meeting labour market testing requirements is closing. Be sure to advertise positions now to secure your applications.

Act Now for High-Risk Occupations
Workers in high-risk occupations, such as Café or Restaurant Managers, should act quickly to renew their visas, especially if transferring to new sponsors. This will ensure they accumulate 2 years of full-time work experience with their current sponsor, qualifying for the 186 Temporary Residence Transition stream before any potential removals from the skilled occupation list.
