Spouse visa applications can be some of the most challenging but also, at the same time some of the most rewarding as the goal is to be reunited with your loved one.
Spouse visa – what are they?
Here are a few tips from the EMSA team on how to make the journey successful:
Generally, there are two types of applications for spouse visas: Temporary and Permanent.
They can both be submitted at the same time and in or outside of Australia. Which way you do will depend on your personal situation.
There is also a third type of application which can be used for those who are engaged and wish to bring their fiancé/ee to Australia.
Usually, to be successful in your application, the applicant needs to have met certain key criteria:
- Be sponsored by an Australian Citizen or permanent resident;
- Be in a genuine relationship
- Meet the health and character criteria
What is a genuine relationship?
By immigration standards, this means that you are in a committed, ongoing and authentic relationship to the exclusion of all others.
How do I prove my relationship?
If you are not married to your partner, one of the key things you will need to show is that you and your partner have been living together for at least twelve months.
If you are married or have registered the relationship, you will need to provide evidence of your relationship. The twelve-month period can sometimes be waived in this case.
There is a standard set of documents that you must provide but there are also documents which are specific to each individual case.
Our job is to help you to identify and provide these documents to immigration.
